These general terms and conditions of sale apply to all sales concluded on the online sales site www.tissmebijoux.fr, subject to the specific conditions indicated in the presentation of the items.

ARTICLE 1 : Mandatory information

The website www.tissmebijoux.fr is a service of the company :

ARTICLE 2 : Essential characteristics of the products sold

The www.tissmebijoux.fr website sells :

  • handcrafted jewelery with natural gemstones and beads, created in one-off models or very small series and made by hand using beading and embroidery techniques with needle and thread

The products sold on the www.tissmebijoux.fr website are represented by photographs and described as accurately as possible. However, the product delivered may sometimes differ slightly from the photograph displayed on the site, in particular the reflections and shades of colour. The natural gemstones are carefully selected and natural. As a result, their inclusions, asperities and shades of colour are unique and may not be an exact copy of the photograph displayed on the site.

The customer declares that he/she has read and accepted the general terms and conditions of sale before placing his/her order. Validation of your order therefore implies acceptance of the general terms and conditions of sale.

ARTICLE 3 : Prices

-> The prices of our products are quoted in euros, inclusive of all taxes (TTC).
For orders delivered to a country other than mainland France, the customer acts as the importer of the products they purchase. For all products shipped outside the European Union, the invoice is issued exclusive of tax (customs duties and other applicable taxes). The customer is therefore responsible for declaring and paying any customs duties or other taxes that may be payable in their country.

  • Delivery charges are not included in the price. They are added to the total order amount just before the customer makes payment.

TISS'MÉ reserves the right to change its prices at any time, on the understanding, however, that the price listed in the catalogue on the day of the order will be the only one applicable to the customer.

-> Prices are invoiced exclusively in euros (EUR), regardless of the display currency. For information purposes, Shopify may display an estimated price in the customer’s local currency, without this constituting a price commitment in that currency. Any conversion is carried out by the customer’s bank or payment provider at the exchange rate in force on the date of the transaction. TISS’MÉ cannot be held liable for any exchange fees or commissions applied by the customer’s bank.

ARTICLE 4 : Product availability period

Products that are available and in stock appear on the www.tissmebijoux.fr website. If they are not, this is indicated. As the brand mainly offers unique models or products available in very small series, new items are added to the site as and when they become available in order to best meet our customers' expectations.
If you have ordered a product that is unavailable after your order has been confirmed, you will be informed immediately. It can then be manufactured at your request, subject to a small delay (manufacturing time) or we will cancel your purchase and refund your money.

ARTICLE 5 : Order

You can order our products directly from our website. To place an order on our site, choose your items and add them to the basket. Confirm the contents of your basket.

  • If you already have a customer account on our site, please log in.
  • If you do not have a customer account on our site, please create one.

You will receive an e-mail confirming your order at the e-mail address you gave when creating your customer account or when confirming your order. Check the details and total amount of your order. Correct any errors before accepting your order.

All orders will only be considered and processed once payment has been received in full. Confirmation of the order implies acceptance of these Terms and Conditions of Sale and acknowledgement of full knowledge thereof. TISS'MÉ reserves the right to cancel or refuse any order from a customer with whom there is a dispute concerning the payment of a previous order.

ARTICLE 6 : Bespoke Orders

TISS'MÉ offers bespoke jewellery in two ways :

  • Customisation of an existing design (choice of stones, colours, size): estimated production time of 1 week from receipt of the deposit.
  • Bespoke creation with design developed in collaboration with the customer : estimated production time of 15 days from project approval.

-> These times are provided for guidance only and may vary depending on the availability of materials.

  • Deposit : All custom orders require a deposit of 30% of the total amount. Production begins upon receipt of this deposit. In the event of cancellation of the order by the customer, the deposit is retained by TISS'MÉ as compensation for work already undertaken.
  • Modifications and approval : Modifications are possible during production, within reason. TISS'MÉ undertakes to submit the product to the customer for approval before finalisation. No modifications will be accepted once the product has been completed and approved.

-> Custom orders are excluded from the right of withdrawal in accordance with Article L221-28 of the French Consumer Code.

ARTICLE 7 : Delivery

For all orders, the processing and dispatch time is 3 working days.

Deliveries are made via Colissimo or Chronopost, at the customer’s choice when placing the order, to the address provided by the customer and require a signature on delivery. Delivery areas, delivery times and applicable rates are detailed in our shipping policy available on the website.

For direct orders (excluding the online shop) or customised orders, other carriers (FedEx, DHL, UPS) may be used depending on the destination. The terms and conditions will then be communicated to the customer by email.

-> Customs duties and taxes applicable outside the EU and French overseas departments and territories are the sole responsibility of the customer.

TISS'MÉ cannot be held liable for delivery delays attributable to the carrier or to a case of force majeure resulting in the deterioration or loss of the product. Under French law, force majeure refers to any external, unforeseeable and unavoidable event.

NB : In addition to those usually recognised by the case law of French courts and tribunals, the following are notably considered as force majeure or fortuitous events: total or partial strikes, lockouts, bad weather, epidemics, blockages of transport or supply routes for any reason whatsoever, earthquakes, fire, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes to marketing practices, interruptions or disruptions to the electricity, internet or telecommunications networks, and any event beyond the express control of the Parties preventing the normal performance of the Contract.

ARTICLE 8 : Terms of payment

Payments on www.tissmebijoux.fr are secure and processed via the Shopify Payments platform. The following payment methods are accepted:

  • Credit card: Visa, Mastercard, American Express
  • Apple Pay
  • PayPal

Full payment for the order is required for all purchases of products in stock.

-> For bespoke orders, payment is made in two instalments and outside the online shop, via electronic invoicing and a secure Stripe payment link sent by email:

  • A 30% deposit upon order confirmation, triggering the start of production
  • The remaining 70% before dispatch of the finished product

-> A detailed invoice will be sent to you by email for each payment instalment.

TISS'MÉ reserves the right to refuse any order in the event of a dispute relating to a previous payment.

ARTICLE 9 : Right of withdrawal

In accordance with article L221-18 of the French Consumer Code, you have the right to cancel your order within 14 working days of receiving the item. You do not have to justify your decision or pay any penalties, apart from the cost of returning the goods. 

The item(s) must not have been worn/tried on and must be returned in their original packaging.

Personalised models made to order are excluded from the right of withdrawal.

Return the product within the above-mentioned period. Within the same period, inform us of the exercise of your right of withdrawal by e-mail to tissme.paris11@gmail.com.

Transport costs and risks are at your charge.

In order for our returned product to be marketable again, you undertake to return it to us in its original packaging and in perfect condition.

ARTICLE 10 : Conditions and deadlines for reimbursement following the right of withdrawal

Once the return of the product has been received and if it complies with the conditions set out in Article 9, the products will be reimbursed in full. Reimbursement will be made by bank transfer/PayPal as soon as possible and no later than 14 days from the date on which the right of withdrawal is exercised.

ARTICLE 11 : After-sales service

As a gesture of goodwill, and without any legal obligation, TISS'MÉ will process repair requests within 3 months of receiving the order. This commercial warranty covers manufacturing defects identified under normal conditions of use. It does not apply to damage resulting from improper use, an accident, normal wear and tear, or external intervention.

-> Beyond this period or for any other reason, repairs may be carried out on the basis of a quotation, at the customer’s expense.

This commercial warranty is in addition to the two-year statutory warranty of conformity provided for in Articles L217-3 et seq. of the French Consumer Code, which the customer may always invoke.

ARTICLE 12 : Consumer Complaints

All consumer complaints should be sent by post to TISS'MÉ, Jacinta LEMENN, 66 rue de la Folie-Régnault, 75011 PARIS or by e-mail to tissme.paris11@gmail.com.

ARTICLE 13 : Intellectual property

All elements of the www.tissmebijoux.fr website: jewellery, texts, images, graphics, logos, designs, are the exclusive intellectual property of TISS'MÉ.
Under intellectual property and copyright, any reproduction of our site, whether partial or total, is strictly prohibited.

ARTICLE 14 : Indexing by artificial intelligence services

The public content on the www.tissmebijoux.fr website (product descriptions, images, prices) may be indexed and referenced by third-party artificial intelligence platforms that are partners of Shopify (including ChatGPT, Microsoft Copilot and other agent-based commerce services). This indexing is limited to public data from the catalogue and does not constitute a transfer of rights to content protected by TISS'MÉ’s intellectual property. All designs, visuals and texts remain the exclusive property of TISS'MÉ.

ARTICLE 15 : Personal data

Certain customer details will be passed on to the carrier (namely surname, first name, address, postcode and telephone number) to enable the processing and delivery of the products ordered.

No personal information is sold to third parties for commercial purposes. Certain data may be passed on to our subcontractors strictly for the purpose of providing our services, and TISS'MÉ reserves the right to collect information about customers, including through the use of cookies, for statistical analysis. 

ARTICLE 16 : Exclusion of liability

TISS'MÉ jewellery is handcrafted using the following materials : natural gemstones, Miyuki beads (Japanese glass), Czech crystal, braided nylon threads (Fireline – Wildfire) and settings in 925 sterling silver, 3-micron gold-plated 925 sterling silver, 14k gold-filled (585/1000 gold-plated) or stainless steel, depending on the model.

These materials comply with current regulations regarding the composition of jewellery. The detailed characteristics of each piece are specified in the product description on our website.

TISS'MÉ cannot be held liable for allergic reactions resulting from a customer’s particular sensitivity to any of these materials. If in doubt, please contact us before making your purchase at tissme.paris11@gmail.com.

ARTICLE 17 : Applicable law

In the event of a dispute between the consumer customer and our company, French law shall apply.

CONSUMER MEDIATION

In the event of a dispute between the Customer and the company, they shall endeavour to resolve it amicably (the Customer shall send a written complaint to the professional or, where applicable, to the professional's Customer Relations Department).
In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the Customer, as a consumer within the meaning of Article L.612-2 of the Consumer Code, may, if the disagreement persists, refer the matter free of charge to the competent mediator listed on the list of mediators established by the Commission for the Evaluation and Control of Consumer Mediation in accordance with Article L.615-1 of the Consumer Code, namely:
